Agreement of Sale

Mycrokleen reserve the right, without notice and in their sole and absolute discretion, to make changes to the website and/or these terms. It is your responsibility to review these terms on each occasion prior making use of Mycrokleen services. Governing Law and Jurisdiction

This Website is hosted, controlled and operated within the Republic of South Africa, and is therefore governed by South African laws and is subject to the ‘Disputes’ set out hereunder, which records that you and Mycrokleen submit to the non-exclusive jurisdiction of the South African courts, subject to the provisions of Clause 10.

Any person that delivers or attempts to deliver any damaging code to the website, or attempts to gain unauthorized access to any page on the website shall be prosecuted and civil damages shall be claimed in the event that Mycrokleen suffers any damage or loss as a result of such conduct.

You agree and warrant that your log-in name and password shall be used for your personal use only and never be disclosed to any third party. Any losses incurred due to transactions occurring by anyone using your log-in details shall be your responsibility only and Mycrokleen shall bear no responsibility in any way arising from such conduct.

Disputes

Save for urgent or interim relief, which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and Mycrokleen on any matter provided for in, or arising out of these Terms and Conditions, and not resolved through the Customer Relations Department of Mycrokleen, then such dispute shall be submitted to confidential arbitration in terms of the Expedited Rules of the Arbitration Foundation of South Africa. Arbitration proceedings shall be conducted in Johannesburg in English.

Return Policy

Returns can be made should the products fail to be reasonably suitable for the purposes for which they are generally intended; be of good quality, in good working order and free of any defects; or be useable and durable for a reasonable period of time, having regard to the use to which they would normally be put and to all the surrounding circumstances of their supply.

You may return the product(s) within 7 (Seven) working days of date of receipt thereof.

Please note that proof of payment must be produced at the time of the return.

In the event that the product is defective, faulty or unsafe, and within 7 working days of the purchase of the products, you may return the defective, faulty or unsafe product with the proof of payment, and may elect one of the following options:

• a full refund of the product(s) purchased; or
• to repair product(s) purchased; or
• to replace the product(s) purchased.

Should Mycrokleen repair any particular product(s) or any component of such product(s) and within 5 working days after that repair, the faulty or defective feature has not been remedied, or a further faulty or defective feature is discovered; Mycrokleen will replace the goods or refund the purchase price paid by you.

Mycrokleen will not be responsible for normal wear and tear, evaporation, leakage at your premises etc.
